Domestic Relations Orders (DROs) and Qualified Domestic Relations Orders (QDROs).

A divorce or legal separation judgment often defines each spouse’s interest in retirement plans, like pensions, 401K accounts and deferred compensation plans. This is important, but in most cases, the judgments themselves can’t be used by the plan administrators to effectuate the ordered division. Plan administrators need special orders, typically called Domestic Relations Orders (DROs) for government-sponsored plans, and Qualified Domestic Relations Orders (QDROs) for private-sector plans. This final step is crucial to finalize the division but is easy to overlook by litigants already worn out by litigation.

How long after the divorce can a QDRO be entered?+

There’s no real limit here. California courts retain jurisdiction to enter DROs, QDROs and other division orders well after the final judgment has been made.

What if my ex-spouse is already receiving retirement payments or income?+

Your interest does not expire even if the other party is receiving retirement payments or income prior to the division order with the plan administrator. Additionally, the amount that your ex-spouse received that belongs to you is also recoverable.

Do I need a separate order for each retirement account?+

Generally yes. Each plan administrator approves orders to its own format. A single QDRO can sometimes cover multiple plans under the same administrator; in most cases each account gets its own order.

What does plan pre-approval involve?+

Most administrators offer a pre-approval process: you send the draft order, they review it for compliance with the plan terms, and they either approve it or request specific revisions. Obtaining pre-approval avoids delay and procedural headaches.

Do I need a pension valuation?+

Only if the parties are negotiating a buyout in lieu of dividing the pension, or if the community share calculation is contested.
